Where AI use becomes a legal question
A communicator uses AI to draft a product announcement. AI adds a performance claim that sounds reasonable but is unverified. The claim goes out. Months later, a competitor’s legal team is asking questions. The AI didn’t know the claim was problematic — it had no way to know. But the communicator who approved it did.
AI does not know what your organization has been approved to say. It doesn’t know what’s pending legal clearance, what’s restricted by a settlement, what claims require substantiation in your industry, or what your investor relations team has signed off on. It produces text that sounds reasonable based on patterns in its training data. Reasonable-sounding is not the same as legally safe.
This isn’t a reason to avoid AI for communications work. It’s a reason to know exactly which content categories require a layer of review that AI cannot provide.
Key Insight
The goal of legal guardrails isn’t to make you fearful — it’s to free you up. When you know exactly which categories of content require review and which don’t, you can use AI confidently everywhere else without second-guessing every sentence.
Factual claims about products, services, or performance. Statements like “the leading solution in its category,” “reduces costs by 40%,” or “the most secure platform available” may require substantiation. AI will generate these freely. Your organization’s legal and marketing teams define which claims are approved.
Regulated industries. Healthcare, finance, pharmaceuticals, legal services, and other regulated sectors have specific rules about what can and cannot be communicated publicly, how disclosures must be written, and what requires professional oversight. AI is not calibrated to these requirements. Content in regulated areas should always have expert review.
Confidential or sensitive information. AI tools process everything you put into them. Entering confidential client information, unreleased financial data, personnel matters, or legally privileged information into a public AI tool creates data handling risks your organization may not have accounted for. Know your organization’s policy before you input sensitive content.
Copyright and originality. AI output may reproduce language that closely mirrors its training data. For most standard business communications this risk is low, but for creative or marketing content — slogans, creative copy, original characters — it’s worth understanding where your organization stands.
The practical output of this module is a simple map of your content types organized by risk level. Three columns: use AI freely (internal drafts, routine emails, social copy for review), use AI then review (external releases, client communications, anything with specific claims), keep human-drafted (regulated content, investor communications, crisis statements, legally sensitive messaging). Once this map exists, the decision about when to involve legal or compliance is no longer a judgment call in the moment — it’s already been made.
Build your personal content risk map — a simple framework that tells you at a glance how much review any piece of AI-assisted content requires before it goes out.
List the ten to fifteen content types you produce most often — press releases, internal memos, executive bios, social posts, product copy, client proposals, whatever applies to your role.
Sort each content type into one of three columns: use AI freely, use AI then review, keep human-drafted. When in doubt, put it in the middle column — you can move it later once you have organizational guidance.
For anything in the “use AI then review” column, note what specifically triggers the review: specific claims, external audience, regulated topic, confidential information. This becomes the decision rule.
Check whether your organization has an existing AI use policy or data handling guidelines. If it does, adjust your map to match. If it doesn’t, flag that gap — you’ll address it in Module 9.
